Terms of Use and Conditions of Order


Alpha Mach Inc. operates this web site (i.e., the web site located at www.alphamach.com); this web site is referred to as the “Site”.

By accessing and using the Site, you agree to each of the terms and conditions set forth herein (“Terms of Use”). By ordering products, you agree to the Terms of Use, as well as the Conditions of Order, set below. These Terms of Use, together with the Conditions of Order, are referred to as this “Agreement”.

  1. Access to the Site. Registration is not required to place an order or use the Alpha Mach’s Web site. the Site offers expanded services via the web through a name/password protected system.


    Your username and password are referred to as your “Identification”. You are solely responsible for keeping your Identification confidential. You agree that you and your authorized representatives will be the only users of your Identification, and that you will be solely responsible for all activities on the Site using your Identification. We strongly recommend that you log out of the Site and close the browser when your session is completed to help prevent unauthorized persons from accessing your Identification.

  2. Intellectual Property. The Service, the Site, and all information and/or content that you see, hear or otherwise experience on the Site (the “Content”) are protected by Canadian, U.S. and international copyright, trademark and other laws, and belong to Alpha Mach Inc. or its partners, affiliates, contributors or third parties.

    Alpha Mach Inc. grants you a personal, non-exclusive, non-transferable license to use the Site, the Service and the Content and to download, print and store portions of the Content that you select, provided that: (1) you only use these copies of the Content for your own internal business purposes or your personal, non-commercial use; (2) if you are a competitor of Alpha Mach Inc., commercial aggregator of data, or other commercial user, do not copy or post the Content on any network computer or transmit, distribute, publish or broadcast the Content in any media; and (3) you do not modify or alter the Content in any way, or delete or change any copyright or trademark notice. No right, title or interest in any downloaded Content or materials is transferred to you as a result of this license. Alpha Mach Inc. reserves complete title and full intellectual property rights in any Content you download from the Site, subject to this limited license for you to make personal use of the Content as set forth herein.

    You may not use any of the marks or logos appearing throughout the Site without express written consent from the trademark owner, except as permitted by applicable law.

  3. Warranties. Alpha Mach Inc. warrants our products against defects in material or workmanship, as follows: for a period of one (1) year from date of purchase, Alpha Mach Inc. shall at its sole and absolute option, either repair the defective product at no charge or replace the defective product with the same model or its equivalent model at no charge. Proof of purchase in the form of a bill of sale or receipted invoice, which indicates that the product is within the warranty period, must be presented to obtain warranty service. Alpha Mach Inc. suggests that the purchaser retain the dated bill of sale as evidence of the date of purchase. This warranty does not cover cosmetic damage, and/or damage to any part of the product resulting from “acts of God”, accident, misuse, abuse, improper maintenance, a depleted internal battery power source, or connection to an improper voltage supply.


    REPAIR OR REPLACEMENT, AS PROVIDED UNDER THIS WARRANTY, IS THE EXCLUSIVE REMEDY OF THE CONSUMER. ALPHA MACH INC. SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTAL DAMAGES OR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON THIS PRODUCT. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW. ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THIS PRODUCT IS LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY.


    Please note that when electronics devices are placed on wild animals, the animals themselves are often capable of damaging the electronics sufficiently to cause either poor performance or no performance. Thus, we reserve the right to investigate the cause of any failure or poor performance to the extent possible to determine what we can about the fate of the electronics. Damage to our electronics that was caused by animal behavior may or may not be covered by warranty. These situations will need to be determined on a case to case basis.
